Pennsylvania Supreme Court upholds conviction for “knowing control” of child pornography

In Commonwealth of Pennsylvania v. Anthony Diodoro, No. J-91-2008 (Pa. May 26, 2009) the Pennsylvania Supreme Court upheld the criminal conviction of Anthony Diodoro for “accessing and viewing child pornography over the internet”—i.e. “knowingly controlling” under 18 Pa.C.S. § 6312(d).

The Right and Wrong Responses to “Sexting”

Mary Graw Leary discusses the unintended consequences of proposed legislation in Vermont that would exempt certain age-groups participating in the sending of “sexually charged” images or videos via cell phone from being classified as sex offenders. According to Leary, the legislation will (1) ignore the “unique harm” presented by the easy distribution of such images; (2) impede the investigation of actual child pornography; (3) “provide a built-in defense for pedophiles”; and (4) expand the “marketplace” of child exploitation.
